RESOLUTION ADOPTING ORDINANCE NO. 2020-9

an ordinance TO AMEND THE TOWNSHIP’S ZONING ORDINANCE TO REZONE PROPERTY

 

At a meeting of the Township Board for the Township of Handy, Livingston County, Michigan, held on the 28 day of APRIL, 2021 at 9:30 A.M.

PRESENT:  EISELE, MUNSELL, ALVERSON, SHEAR, RODDY.

 

ABSENT:    NONE.

 

            The following preamble and resolution were offered by EISELE and seconded by MUNSELL.

WHEREAS, pursuant to the Michigan Zoning Enabling Act, Act 110 of 2006, MCL 125.3101 et seq, as amended ("MZEA"), the Township has the authority to re-zone land within the Township; and 

WHEREAS, the Township desires to consider amending the Township’s Zoning Ordinance to rezone property in the Township as follows:

  1. Rezoning of property located in the NE and SE Corners of Section 11 and NE Corner of Section 14 set forth below from RB, Residential B District to RA, Residential A:

  1. Rezoning of property located in the NE Corner of Section 11 set forth below from RB, Residential B District to MP Municipal Property District:
    1.  W Sharpe; Parcel ID: 4705-11-200-012

 (“Proposed Amendments”); and

WHEREAS, upon giving notice in accordance with the MZEA, the Township Planning Commission held a public hearing regarding the Proposed Amendments on February 25, 2021; and

WHEREAS, following the public hearing, the Planning Commission considered the amendment and decided to make a recommendation to the Township Board that the Proposed Amendment be approved; and 

WHEREAS, the Township Board has considered the Proposed Amendment and wishes to adopt the Proposed Amendment as recommended by the Planning Commission (see “Ordinance” attached as Exhibit A).

NOW, THEREFORE, IT IS RESOLVED AS FOLLOWS:

  1. Ordinance No. 2020-9, Ordinance to Amend the Township’s Zoning Ordinance to Rezone Property (attached as Exhibit A) is hereby adopted.
  2. The Ordinance shall be filed with the Township Clerk.
  3. The Township Clerk shall publish a summary of the Ordinance in a newspaper of general circulation in the Township within 15 days.
  4. Any and all resolutions that are in conflict with this Resolution are hereby repealed to the extent necessary to give this Resolution full force and effect.

            A vote on the above Resolution was taken and was as follows:

Section 2. Validity and Severability           

Should any portion of this Ordinance be found invalid for any reason, such holding shall not be construed as affecting the validity of the remaining portions of this Ordinance.

Section 3. Repealer  

Any ordinances or parts of ordinances in conflict herewith are hereby repealed but only to the extent necessary to give this Ordinance full force and effect.

Section 4. Effective Date

This ordinance shall become effective seven days following publication as provided by law.
